Legal definitions:
Under workers' comp law:
(1) Partial Disability: Incapacity, in part, from returning to the work
performed prior the development of the health problem.
(2) Total Disability: Arises when one is prevented from engaging in his
*usual* occupation even though he may still be able to perform various duties
and be present in his place of business. Total disability does not mean
absolute physical disability, or the inability to transact any business
pertaining to the workers usual occupation.
The above legal definitions are followed by social security, and all laws,
rules, and regulations concerning the administration of social security
benefits.
In order to change the above definitions, new case law would have to be
created.
